General Terms and Conditions of Sale and Use

Please read these terms before using getpasovia.com or placing an order. By purchasing, you agree to be bound by them.

1. Identification of the owner

Emrerdemnet LTD is established in the United Kingdom. By directing its offer to consumers residing in Spain, it applies Spanish and European consumer regulations, in particular Royal Legislative Decree 1/2007 (TRLGDCU) and Law 34/2002 (LSSI-CE).

2. Who can purchase

You must be over 18 years old and have the legal capacity to enter into a contract. The store is aimed at consumers purchasing for personal use, not for resale.

3. The product

Pasovia is a mobile hinged splint for home use, designed to make your time at home more comfortable when you feel pressure on your big toe.

It is not a medical product and does not replace the diagnosis, prescription, or treatment of a healthcare professional. If you have constant pain, inflammation, have undergone surgery, or are under treatment, consult your podiatrist before use.

Photographs and videos are representative. There may be minor differences in tone or finish compared to the unit received.

4. Prices and orders

Prices are displayed in euros and include applicable VAT. Shipping costs, if any, are indicated separately before confirming the order.

We may modify prices at any time, but the price applicable to your order is the one displayed when you confirm it. A subsequent change does not affect you.

The contract is perfected when you receive our order confirmation by email. If, due to an obvious pricing error or lack of stock, we cannot fulfill it, we will inform you and provide a full refund.

5. Right of withdrawal

You have 14 calendar days from receipt of the product to withdraw without justifying your decision and without penalty.

How to exercise it: notify us at info@getpasovia.com by means of an unequivocal statement or by using the form at the end of this document.

Product return: send it back within a maximum period of 14 calendar days from the date you notify us of your decision.

Return cost: the direct costs of the return are borne by you, in accordance with Article 108.1 of the TRLGDCU. We expressly state this to you here before purchase, as required by law.

Refund: we will refund all payments received, including standard delivery costs, within a maximum of 14 calendar days from your notification. We may withhold the refund until we receive the product or until you provide proof of return.

You are responsible for any diminished value resulting from handling other than what is necessary to establish the nature and functioning of the product.

6. Legal guarantee of conformity

You have the right to a 3-year legal guarantee of conformity from delivery (Articles 114 et seq. of the TRLGDCU).

If the product is not in conformity, you may demand its repair or replacement and, if not applicable, a price reduction or termination of the contract. During the first two years, it is presumed that the lack of conformity already existed at delivery, unless proven otherwise.

To file a claim, write to info@getpasovia.com describing the problem and attaching photographs if possible.

Important: when the product is defective or non-conforming, all costs are borne by us, including return and reshipping. The previous rule regarding return costs applies only to withdrawals due to a change of mind.

7. Intellectual property

The texts, photographs, videos, logos, designs, and other content on getpasovia.com are the property of Emrerdemnet LTD or its licensors, protected by national and international intellectual and industrial property regulations.

Reproduction, distribution, public communication, or transformation without written authorization is not permitted. Access to the site does not grant any rights over them.

8. Use of the site

You agree not to:

• perform reverse engineering or attempt to obtain the source code;
• introduce illicit, offensive, defamatory content, or content that violates the rights of third parties;
• use automated systems that harm the operation of the site;
• impersonate another person.

Non-compliance may lead to the suspension of access and corresponding legal action.

You must provide truthful data and keep your credentials confidential. If you detect unauthorized use of your account, notify us immediately.

9. Our liability

We strive to ensure that the site operates continuously, but we cannot guarantee the total absence of technical interruptions or occasional unavailability.

Nothing in these terms limits or excludes your legal rights as a consumer, nor our liability for fraud, gross negligence, personal injury, or any case where the law does not allow for exclusion.

10. Force majeure

Neither party shall be liable for non-performance caused by circumstances beyond their reasonable control—natural disasters, fires, armed conflicts, strikes, epidemics, supply cuts, or widespread network failures. Obligations are suspended for the duration of the cause. If it lasts more than 30 days, either party may terminate the contract with a full refund.

11. Modification of these terms

We may modify them to adapt to legal or operational changes. The conditions in force at the time of your order always apply to your order; subsequent changes do not have retroactive effect.

12. Partial nullity

If any clause is declared null and void, the remainder shall remain in force. The affected clause will be replaced by another that respects the original purpose within the limits permitted by law.

13. Data protection

The processing of your data is governed by our Privacy Policy.

14. Claims, applicable law, and jurisdiction

Claims: write to us at info@getpasovia.com. We respond as soon as possible and, in any case, resolve issues within a maximum period of one month.

Applicable law: these terms are governed by Spanish legislation. In any case, you retain the protection of the mandatory provisions of your country of habitual residence (Article 6 of the Rome I Regulation).

Jurisdiction: as a consumer, you may file a lawsuit in the courts of your place of residence and you can only be sued in the courts of your own place of residence (Articles 17 to 19 of Regulation (EU) 1215/2012).

Alternative dispute resolution: you may turn to the Consumer Arbitration System or the municipal consumer information office in your locality.
